Terms and Conditions of Participation for Exhibitors at Physical Events of Personio SE & Co. KG
1. Organizer
1.1 Personio SE & Co. KG, Seidlstraße 3, 80335 München (“Personio”) holds events (“Event” or “HUG”).
1.2 Participation in the Event as an employee at the booth (“Exhibitor”) of an HUG Partner (“Partner”) is subject to the following provisions (“Terms and Conditions of Participation”).
2. Object and applicability
2.1 The Terms and Conditions of Participation govern the rights and duties in connection with the work of the Exhibitor at the physical Event.
2.2 By agreeing to work at the Event as an Exhibitor of the Partner, the Exhibitor accepts these Terms and Conditions of Participation.
3. Duties of cooperation of the Exhibitor
3.1 The Exhibitor shall receive an Exhibitor ID card. The ID card identifies the Exhibitor as a booth worker on site and authorizes the Exhibitor to enter the Event and work at the booth of the Partner, and must therefore always be worn so as to be easily visible.
3.3 During the Event, the Exhibitor undertakes to follow the house rules of the Event location and the hygiene regulations set out by Personio.
4. Copyright
4.1 All printed and online materials (especially photos, films, and videos), keynotes, expert talks, interviews, panel discussions, workshops, and the computer software provided by Personio are all protected by copyright. These printed and online materials may not be generated, copied, or disseminated to third parties without the prior consent of Personio.
4.2 Industrial sound and image recordings may not be generated, copied, or disseminated to third parties without the prior consent of Personio.
5. Image, video, and sound recordings by the Exhibitor
5.1 The Exhibitor consents to the production of image, video, and sound recordings for the duration of the Event. By attending the Event, the Exhibitor authorizes Personio and any subcontractors hired by Personio to use these recordings – with no restrictions in terms of content, geographical territory or time – for the purposes of reporting and advertising on commonly used sales and content-sharing channels.
5.2 The Exhibitor can withdraw this consent at any time with future effect by sending an e-mail to events@personio.de.
6. Liability
6.1 The liability of Personio for damage resulting from injuries to life, limb, or health, and for other damage due to an intentional or grossly negligent breach of duty or fraudulent intent, has no limit under the statutory provisions.
6.2 Personio can only be held liable for ordinary negligence if the damage is due to a breach of a key contractual duty which jeopardizes the achievement of the purpose of this Agreement or due to a breach of a duty which must be fulfilled before the contract can be duly executed and on the fulfillment of which the Exhibitor can normally rely (i.e. material contractual duties). In these cases, its liability shall be limited to compensation for the typical direct damage that was foreseeable as of the conclusion of the contract. Liability under mandatory law notwithstanding, Personio cannot be held liable for an ordinarily negligent breach of duty if the duty is not a material contractual duty.
6.3 Where the liability of Personio is excluded or limited under the provisions above, this shall also apply to its legal representatives and/or vicarious agents.
7. House rules
7.1 During the Event, the house rules of Personio apply to the entire Event venue. Exhibitors must follow any instructions issued by Personio or third parties engaged by Personio to carry out the Event in order to comply with the house rules or hygiene regulations.
7.2 In the event of a breach of the house rules or if the instructions of Personio or third parties engaged by Personio to carry out the Event are disobeyed, Personio reserves the right to either prevent Exhibitors from entering the Event or remove Exhibitors from the Event.
8. Data protection
8.1 The Partner shall provide Personio with the following personal data relating to the Exhibitor in order to register the Exhibitor for the Event: first name, surname, position, e-mail address, and company name.
8.2 In order to facilitate registration for the Event, the execution of the Event, and follow-up work on the Event, these personal data are collected, processed, and stored for the performance of a contract in accordance with point (b) of Article 6(1) GDPR. It may be necessary for the data to be shared with third parties engaged by Personio for this purpose. The Exhibitor is
reminded that he/she can withdraw this consent at any time and with future effect.
8.3 Data shall be collected, processed, and used in accordance with the GDPR. More information about data protection and the purposes, nature, and scope of the collection, processing, and use of personal data is available in the privacy policy (https://www.personio.com/privacy-policy/).
9. Conclusion
9.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the participant is a consumer, this choice of law only applies in so far as the protection is not withdrawn by mandatory provisions of the law of the state in which the consumer has his/her habitual residence.
9.2 If any individual provision of these Terms and Conditions of Participation should prove not to be a contractual component or ineffective, this shall not affect the rest of the provisions. Where individual provisions have proven not to be contractual components or ineffective, the content of the Agreement shall be subject to the statutory regulations.
9.3 Where these Terms and Conditions of Participation are used in other languages, the translated versions are for informational purposes only. In cases of doubt, the German version shall always take precedence.
